Perjury... when a witness becomes a murderer in the name of justice!
Prepared by: Professor Mubarak Bajash Al-Bakari
An Analysis of the Most Dangerous Crime in the Courtroom: "I swear by Almighty God to tell the truth, the whole truth, and nothing but the truth." With this oath, which shakes the very foundations of hearts, the law grants an ordinary person immense power: the power to shape the judge's conviction. Their words are no longer mere letters, but become building blocks in the edifice of justice, or tools for its destruction. The witness is the eye and ear of the court, its living memory, which returns to the scene of the crime to uncover the truth. But what happens when this eye is deceitful, this ear is deaf to the truth, and this memory is poisoned by betrayal? What if the witness, driven by malice, greed, or fear, decides to assassinate the truth on the bench? Here, it is not merely a lie, but rises to one of the most heinous and dangerous crimes of all: perjury. It is a crime not committed in darkness, but under the lights of the courtroom, and it not only misleads justice but uses it as a tool to destroy the lives of the innocent.
In this legal analysis from the Know Your Rights and Law platform, we will delve into Article (179) of the Yemeni Crimes and Penalties Law, to reveal why the legislator dealt with the false witness so harshly that he may be considered a murderer deserving of execution.
